David Lawrence: Right, I would suggest to you that you review the tests for fare use, it doesn*t matter whether money is being exchanged or not. The fact is that, you are using it in a situation that may not be authorized by those people like * if you go into CNN for example, or if you are go into Yahoo News or if you are go into Google News, as a law enforcement trainer you know I would think that you would want to be exemplary in what you display to the law enforcement officers that are in your charge. And so what I would do is when you grab something from a site a simple E-mail to them to say may I please use this in training law enforcement officers. It goes a long way towards them never coming back to you or somebody raising their hand in class and going I am a lawyer, did you get permission to do that?
John: Okay.
David Lawrence: You know what I am saying?
John: Oh, yeah it*s helpful.
David Lawrence: And if you come upon a site where you can*t Right Click and Save Target As again writing to the site and saying hey look I couldn*t get your clip. I would like to use it in training law enforcement officials do you have it available in Windows Media or QuickTime, they might just sent it to you.
John: Okay.
David Lawrence: So that's one thing I would do and that's probably why you can*t do it in all cases. And Ms. Von Schtupp just instant messaged and said isn*t educational use a part of fair use? It is if you are only using a very small portion of it. Again the four tests include whether or not you are using all of it or just a small part of it as part of a whole and for social or educational or political commentary. That's different from training, you cant as a teacher take a book and photocopy it in whole nor can you take a movie and copy it in whole and play it for your class. That's not what they mean by education, so I just wanted to clear that up.
