What happens when an organization brings a lawsuit against a company for a criminal act, and then engages in the same criminal act themselves?

In the age of things being done at Internet speed, we're often very quick to point fingers at both real and imagined wrongs "perpetrated" by "heinous entities." Sometimes, these wrongs are not done on purpose, or with harm in mind. Sometimes, a slip of the finger on a keyboard can cause disastrous results.
Such is the case here, and further, the "aggrieved" ACLU should think twice before bringing other suits against organizations whose activities are far from nefarious. I wonder how Barry Steinhart is going to explain away the actions of his organization, after mercilessly pounding away at Eli Lilly for the same actions, even bringing the case to the Federal Trade Commission, and seeking sanctions from the government.
Both instances, the inadvertant display of e-mail addresses on a mailing list, are examples of human error, not uninformed policy or outright fraud. We all need to think twice before pouncing on individuals or organizations for doing something by accident, unless we can guarantee that our actions and the actions of others are not in any way questionable, or in danger of being judged in the same light.
